What is an Industrial Design?

An Industrial Design protects the visual appearance or aesthetic features of an article rather than its functional or technical aspects. It relates to the features of shape, configuration, pattern, ornament or composition of lines or colours applied to an article, whether in two-dimensional or three-dimensional form, which appeal to and are judged solely by the eye.

In India, Industrial Designs are governed by the Designs Act, 2000 and the Designs Rules, 2001. Registration grants the registered proprietor exclusive rights to apply the registered design to the relevant article, subject to the provisions of the Act.

Design registration encourages creativity by protecting the distinctive appearance of products, enabling businesses to differentiate their goods in the marketplace and prevent unauthorised imitation of registered designs.

A design protects only the visual appearance of an article. It does not protect the article's technical function, method of manufacture or underlying invention. Where technical innovation exists, protection may also be available under the Patents Act, 1970, subject to the applicable legal requirements.
